Terms of Service

1. Who these Terms cover

These Terms govern your use of the Destiny Rings mobile app, website, and related services (the "App" and "Services"), and the software and firmware that run on Destiny Rings smart rings. By creating an account or tapping "Agree and continue," you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and legally able to enter a contract. You may not use the Services if you are barred by law from doing so. You confirm that the birthdate and other information you give us are accurate. We may ask you to verify your age and may remove accounts that appear to belong to anyone under 18.

3. Your account

You are responsible for your account and for activity under it. Keep your sign-in details private and tell us promptly at hello@yourdestinyrings.com if you think someone else has access. One person, one account. Do not impersonate anyone or create a profile that is misleading about who you are.

4. License

Subject to these Terms and applicable App Store rules, Destiny Rings grants you a limited, revocable, nonexclusive, nontransferable, nonsublicensable license to use the App, Services, and associated software and firmware for their intended personal purposes. Suspension, revocation, and termination are governed by these Terms and applicable consumer law, including rights relating to paid features.

Buying a ring gives you ownership of the physical ring. It does not give you ownership of, or any rights in, the software, firmware, or Services, which stay licensed to you under this section.

5. Restrictions

Without our written authorization, you may not:

• reverse engineer, decompile, disassemble, or attempt to extract nonpublic source code, algorithms, matching or scoring logic, server protocols, ring firmware, or wearable communication protocols;
• copy, clone, modify, or create derivative works of our proprietary software, firmware, or protected content;
• circumvent access controls or exceed authorized access;
• scrape or systematically collect profiles, messages, location information, or other Service data except through expressly authorized features; or
• use misappropriated nonpublic materials or data obtained in violation of these Terms to develop a competing product or service.

These restrictions do not limit rights that applicable law prohibits us from restricting or rights granted by applicable open-source licenses. They do not prohibit lawful independent development, authorized data export, or the exercise of applicable privacy rights.

6. How matching works, and meeting in person

The Services use your profile, preferences, Bluetooth proximity, and interactions to suggest compatible people nearby. Match scores and suggestions are automated estimates. They are not a statement about any person's character, intentions, or safety, and we do not guarantee any particular result or that you will meet anyone.

A ring interaction or match does not mean consent to anything beyond the connection itself. You decide whether to talk, reply, or meet. Meeting people in person carries risk. We do not conduct criminal background checks on members. Use common sense: meet in public, tell someone where you are going, and leave if you feel unsafe. See the safety notice in the App.

7. Conduct

You may not use the Services to harass, stalk, threaten, or abuse anyone; send spam, scams, or solicitations; post unlawful, hateful, sexually explicit, or violent content; share another person's private information; or use the Services for anything illegal. Respect no: if someone declines, stops responding, or blocks you, stop contacting them.

8. Reporting, blocking, and moderation

You can report a member from the App and block members you do not want to hear from. When you block someone, you stop appearing to each other and any existing match and chat between you is removed. We review reports, and we may remove content, limit features, suspend, or terminate accounts that violate these Terms, with or without notice where needed to protect members. We are not obligated to monitor the Services and are not responsible for what members say or do.

9. Your content

You keep ownership of the profile information, photos, messages, and other content you submit ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, display, and process Your Content solely to operate, secure, and improve the Services and to show it to other members as your settings allow. This license ends when you delete the content or your account, except for copies in backups for a limited time and content other members have already received. You confirm you have the right to post Your Content.

10. Purchases, credits, and refunds

Destiny Rings smart rings are sold separately from the App, and the App does not sell rings. Rings may be sold online or through retail partners, and the terms of the seller you buy from, including returns and warranty, apply to that purchase.

Inside the iPhone app, you can buy circle slots. A circle is a community you choose to join, such as a fan group or shared interest. A slot lets you join one circle, and when you are near a fellow member of a circle you share, the App can alert you and let you match on that circle. Each slot lasts 30 days from purchase unless the App says otherwise at checkout. Circle slots are tied to your account, not your device. Purchases are processed by Apple under Apple's terms; Apple handles billing and most refund requests. Prices are shown before you buy. Digital items already used are not refundable except where the law requires.

If we offer subscriptions, they renew automatically until cancelled through your Apple account settings or in the App as described at purchase.

11. Suspension and termination

You can stop using the Services and delete your account at any time from the App (Settings → Danger Zone → Delete Account). We may suspend or end your access if you violate these Terms, create risk for other members, or if we stop offering the Services, and where required we will give you notice and handle paid features in line with consumer law. Sections that by their nature should survive termination (including Restrictions, the Your Content license for content already shared, Disclaimers, Limitation of liability, and Disputes) will survive.

12. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services, Bluetooth connections, or rings will be uninterrupted, error-free, or secure at all times, or that members are who they say they are. Ring battery life and Bluetooth range vary with conditions.

13. Limitation of liability

To the fullest extent the law allows, Destiny Rings and its owners, officers, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, or for the conduct of any member, online or offline. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some places do not allow these limits, so they may not apply to you in full. Nothing in these Terms limits liability that cannot be limited by law.

14. Disputes and governing law

These Terms are governed by New Jersey law, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Hudson County, New Jersey, and you and we consent to that venue. Before filing a claim, please contact us at hello@yourdestinyrings.com so we can try to resolve it.

15. Changes

We may update these Terms. If a change is material, we will tell you in the App or by email and ask you to accept the new version before you keep using the Services. We record which version you accepted and when. If you do not agree to the new version, you can delete your account.
